Abstract

Risk and need are at the heart of decision-making processes within the criminal justice system and the management of risk has become, in many respects, a judicialized process. Decisions taken about categorization, release dates, conditions of release, and contact with others affect fundamental constitutional and human rights. Human rights principles are increasingly drawn upon to support claims for access to rehabilitative programs.
