Abstract

Charter schools have sparked a wide variety of litigation. The first two sections of this chapter analyze state constitutional and statutory challenges pertaining to the creation of charter schools. The following sections examine litigation around charter school renewals and revocations; the level of formality required for hearings for applications, revocations, and renewals; litigation that has arisen during the operation of the charter; and the matter of race. The chapter closes with an analysis of the legal issues charter schools have faced with respect to students with disabilities.
